Банки не вправе требовать от организации или ИП извещение о регистрации!

[12.06.2012 23:39:28] При открытии счета организации или ИП банки не вправе настойчиво просить оповещения о записи в роли страхователя Теперь кое-какие кредитные организации при открытии расчетных счетов организациям и индивидуальным предпринимателям требуют представить оповещения о записи юридического лица, индивидуального предпринимателя в роли страхователя в Пенсионном фонде и Фонде социального страхования. Центробанк в письме от 30.05.12 № 75−Т отметил, что такое требование излишне. В первую очередь, данное требование не содержит ни российское законодательство, ни нормативные акты Банка РФ. А, во-вторых, сведения о записи юридического лица, индивидуального предпринимателя в роли страхователя содержатся в выписке из ЕГРЮЛ или ЕГРИП. 


Послание ЦБ РФ от 30.05.12 № 75−Т "Об извещениях о записи в государственных внебюджетных фондах" В коммуникации с поступающей информацией о требовании отдельными кредитными организациями при открытии банковских счетов юридическим лицам, индивидуальным предпринимателям сообщений об их записи в роли страхователей в органах Пенсионного фонда РФ и Фонда социального страхования России Банк РФ передает следующее. Российское законодательство и нормативные акты Банка РФ не содержат требования о представлении в кредитную организацию при открытии банковского счета оповещения о записи юридического лица, индивидуального предпринимателя в роли страхователя в органах Пенсионного фонда РФ и Фонда социального страхования РФ. Сведения о записи юридического лица, индивидуального предпринимателя в роли страхователя в территориальных органах Пенсионного фонда РФ и Фонда социального страхования РФ содержатся в выписке из Единого государственного реестра юридических лиц (Единого государственного реестра личных коммерсантов). Принимая во внимание изложенное, считаем излишним требование кредитными организациями при открытии банковских счетов юридическим лицам, индивидуальным предпринимателям сообщений об их записи в роли страхователей в территориальных органах Пенсионного фонда РФ и Фонда социального страхования России. The Russian legislation and statutory acts of Bank of the Russian Federation do not contain the requirement about representation in the credit organisation at opening of the bank account of the notification about record of the legal person, the individual businessman in a role of the insurer in bodies of the Pension fund of the Russian Federation and Fund of social insurance of the Russian Federation. Data on record of the legal person, the individual businessman in a role of the insurer in territorial bodies of the Pension fund of the Russian Federation and Fund of social insurance of the Russian Federation contain in an extract from the Uniform state register of legal bodies (the Uniform state register of personal businessmen). In view of stated, we consider excessive the requirement as the credit organisations at opening of bank accounts to legal bodies, individual businessmen of messages on their record in a role of insurers in territorial bodies of the Pension fund of the Russian Federation and Fund of social insurance of Russia.
