Минтруд представил новый проект справки о заработке

На сайте Министерства труда размещен новый проект справки о сумме заработка за два календарных года, предшествующих году увольнения или году обращения за справкой, и о количестве календарных дней, приходящихся на периоды, исключаемые из расчетного периода.


   Проект справки состоит из трех листов.(скачать можно здесь) Раздел 1 содержит данные о страхователе, раздел 2 — данные о застрахованном лице, раздел 3 — сведения о сумме заработной платы и иных выплат, на которые были начислены страховые взносы. В разделе 4 указывается количество календарных дней, приходящихся на периоды временной нетрудоспособности, отпуска по беременности и родам, отпуска по уходу за ребенком, другие периоды, если на сохраняемую заработную плату за этот период страховые взносы в ФСС не начислялись.

   При этом Минтруд учел предложение увеличить количество строк в разделе 4 справки, содержащих информацию об исключаемых периодах и предоставлять страхователям в случае необходимости добавлять строки для отражения периодов, исключаемых из расчетного. А вот предложение сократить название справки, которое сейчас насчитывает 11 строк, ведомство не поддержало, обосновав свой отказ тем, что наименование справки дано в полном соответствии с Федеральным законом от 29.12.06 № 255−ФЗ.

   Напомним, с 1 января 2013 года работодатели обязаны указывать в справке количество календарных дней, приходящихся на периоды болезни, декретного отпуска, отпуска по уходу за ребенком и др. До тех пор, пока в форму справки, утвержденную приказом Минздравсоцразвития России от 17.01.11 № 4н, не будут внесены изменения, работодатели вправе отражать необходимую информацию в произвольной форме (письмо ФСС РФ от 11.01.13 № 15−03−18/12−169).

The inquiry project consists of three sheets. In section 4 the quantity of the calendar days having for the periods of time invalidity, holiday on pregnancy and sorts, holidays on care of the child, other periods if on a kept salary for this period insurance payments in ФСС were not charged is underlined.

   Thus Ministry of Labor has considered the offer to increase quantity of lines in section 4 of the inquiry, containing the information on the excluded periods and to give to insurers in case of need to add a line for reflexion of the periods excluded from the settlement. And here the offer to reduce the name of the inquiry which now totals 11 lines, department has not supported, having proved the refusal by that the inquiry name is given in full conformity with the Federal law from 29.12.06 № 255−ФЗ. Let's remind, since January, 1st, 2013 employers are obliged to specify in the inquiry quantity of the calendar days having for the periods of illness, a maternity leave, holiday on care of the child, etc.

   Until in the form of the inquiry confirmed by the order of Minzdravsotsrazvitija of Russia from 17.01.11 № 4н, changes will not be made, employers have the right to reflect the necessary information in any form (letter ФСС the Russian Federation from 11.01.13 № 15−03−18/12−169).
