Вместе с тем, если иное не предусмотрено уставом организации, руководитель компании вправе передать свои полномочия по подписанию бухгалтерской отчетности посредством доверенности, разъясняет ФНС России в письме от 26.06.13 № ЕД-4−3/11569@. Минфин России придерживается аналогичного мнения. В письме ведомства от 30.04.13 № 07−01−10/15212 отмечается, что Федеральный закон № 402−ФЗ не содержит положений, ограничивающих право руководителя компании передать свое полномочие по подписанию бухгалтерской (финансовой) отчетности иному лицу на основании доверенности.

In the letter of department from 30.04.13 № 07−01−10/15212 it is noticed that the Federal law № 402−ФЗ does not contain the positions limiting the right of the head of the company to transfer the power on signing of the accounting (financial) reporting to other person on the basis of the power of attorney.
