Для целей налогообложения при УСН управляющей компании стоит прописать агентирование в контракте Министерство финансов согласен с ФНС, что управляющая корпорация, применяющая УСН, обязана включать в состав доходов суммы, перечисленные ею ресурсоснабжающим организациям за поставленные энергоресурсы. Исключением являются ситуации, когда в контракте управления указывается на то, что управляющая организация выступает в качестве агента. При этом ведомство обращает внимание на следующий нюанс: сделка с третьими лицами агентом, выступающим от собственного имени, однако за счет принципала, обязана быть совершена после заключения агентского контракта и лишь в интересах принципала. В этом случае управляющая корпорация вправе учесть в составе доходов лишь агентское вознаграждение. Детальнее об этом - в письме от 24.08.12 № 03−11−06/2/114.
